01About these terms
These terms apply to your use of scenemedia.in (the “website”) and to services provided by Scene Media (“we”, “us”), a social media and performance marketing agency based in Ahmedabad, Gujarat, India. By using the website or engaging our services, you agree to them.
Each client project is also covered by a written proposal, quotation or agreement (the “Agreement”). If the Agreement and these terms disagree, the Agreement takes priority.
02Using the website
You may browse the website and contact us through it. You agree not to:
- send false, misleading or someone else's details through our forms;
- send spam, malicious code or automated submissions;
- attempt to break, overload or gain unauthorised access to the website or its hosting;
- copy, scrape or reuse our content, designs or client work without written permission.
The website, including case studies, figures and pricing, is for general information. We work to keep it accurate but do not promise it is complete or always up to date.
03Services, quotes and scope
Packages and prices shown on the website are indicative. The exact services, deliverables, timelines and fees for your brand are set out in your Agreement. A quotation is valid for 15 days unless it says otherwise.
Work outside the agreed scope, such as extra reels, shoot days, revisions beyond the agreed number or new platforms, is quoted and billed separately once you approve it.
04Fees and payment
- Monthly retainers are billed in advance at the start of each month, unless the Agreement says otherwise.
- One-time projects (such as websites or brand launches) may require an advance before work starts, with the balance due on delivery.
- Invoices are payable within 7 days. GST and other applicable taxes are added to the fees shown.
- Advertising spend on Meta, Google or other platforms is separate from our fees, and is paid by you directly to the platform or reimbursed to us as agreed.
- Influencer, model, location, prop and travel costs are passed through at actual cost unless included in the quote.
- We may pause work, scheduled posts or ad campaigns while an invoice is overdue.
- Fees already paid are non-refundable for work that has been started or delivered.
05Your responsibilities
To keep the work on schedule, you agree to:
- give us the access, brand assets, product information and approvals we need, on time;
- make sure anything you give us (logos, photos, music, claims about your products) is yours to use and is accurate and lawful;
- review content within the agreed time; content not commented on within 3 working days may be treated as approved;
- keep login details you share with us secure, and tell us if they change.
Delays caused by late feedback, approvals or materials may move timelines and posting dates.
06Ownership of the work
Once you have paid in full, you own the final deliverables made for you, such as approved posts, reels, designs and website files. Until then, we keep ownership.
We keep ownership of our working files, raw footage, templates, tools, methods and know-how, unless the Agreement says otherwise. Stock assets, fonts, music and software used in the work stay subject to their own licences.
Unless you ask us in writing not to, we may show work we have made for you, with your brand name and general results, in our portfolio, website and social media. We will never share your confidential information this way.
07Results and third-party platforms
We plan every campaign to perform, and figures on the website describe real past results. But views, followers, reach, leads, sales and return on ad spend depend on platform algorithms, the market, your product and other things outside our control. We do not guarantee any specific result.
Instagram, Facebook, Google, WhatsApp and other platforms set their own rules and can change features, reject ads or restrict accounts at any time. We are not responsible for their actions, outages or policy changes, though we will help you respond to them.
08Confidentiality
We keep your business information, account access, sales data and unreleased plans confidential, and use them only to deliver your services. We ask the same of you for our proposals, pricing and methods. This continues after the engagement ends.
09Ending an engagement
Either side may end a monthly retainer with 30 days' written notice, unless the Agreement sets a minimum term. Fees for the notice period and for work already completed remain payable. When an engagement ends, we will hand back account access and deliver the paid-for final files.
10Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits, lost sales or lost data. Our total liability for any claim relating to our services is limited to the fees you paid us for those services in the 3 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
11Privacy
How we handle personal data from the website and from enquiries is explained in our Privacy Policy.
12Changes to these terms
We may update these terms from time to time. The “last updated” date at the top shows the current version. Changes do not affect an Agreement already signed, unless both sides agree in writing.
13Governing law
These terms are governed by the laws of India. We will always try to settle a disagreement by talking first. If that does not work, the courts in Ahmedabad, Gujarat will have exclusive jurisdiction.
